Terms of Use for Beanie

1. Acceptance of Terms

By downloading, accessing, or using the Beanie mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these terms, you do not have permission to access the App.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Definitions

  • "Service" refers to the Beanie mobile application
  • "User" refers to anyone who uses the Service
  • "Content" refers to text, images, reviews, recipes, and any other materials posted on the Service
  • "User Content" refers to Content that Users submit to the Service
  • "Feedback" means any comments, questions, recommendations, suggestions, ideas, bug reports, improvements, enhancements, features requests, or other feedback, input, or materials provided or disclosed by you at any time, whether written, oral, or electronic, in any form or medium, relating to the Service, including its functionality, features, content, user experience, or any aspect of accessing, using, or operating Beanie.

3. Account Registration

Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

Account Security

  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • You are responsible for all activities that occur under your account

Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Prohibited Conduct

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Upload or transmit viruses or malicious code
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service
  • Create multiple accounts for deceptive purposes
  • Harass, abuse, or harm other users
  • Post false, misleading, or fraudulent content
  • Use the Service for any commercial purposes without our express written consent

Content Standards

User Content must not:

  • Contain false or misleading information about coffee products
  • Violate any third-party rights (including intellectual property rights)
  • Contain offensive, obscene, or inappropriate material
  • Promote illegal activities
  • Contain personal information of others without consent

5. User Content

License Grant

By posting User Content to the Service, including but not limited to coffee bag images, reviews, recipes, and journal entries, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to:

  • Use, reproduce, modify, adapt, publish, translate, distribute, and display such Content
  • Create derivative works from such Content
  • Use such Content for improving our Service, including machine learning and AI training
  • Display coffee bag images as part of our coffee database
  • Maintain anonymized versions of your Content after account deletion for the benefit of our coffee community

This license is necessary for us to operate the Service, including displaying coffee information to other users. For public content (reviews, public recipes, coffee submissions), this license continues even if you stop using the Service or delete your account, though we may anonymize such content by removing personally identifiable information.

Representations

You represent and warrant that:

  • You own or have obtained all necessary rights to your User Content
  • Your User Content does not infringe any third-party rights
  • Your User Content complies with these Terms

Content Removal

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, without prior notice.

6. Coffee Submissions and Reviews

Accuracy

You agree to provide honest and accurate reviews and ratings of coffee products. Fake or misleading reviews are prohibited.

Coffee Submissions

When submitting new coffee products to our database:

  • Ensure all information is accurate and verifiable
  • Do not submit duplicate entries
  • Include only appropriate images that you have rights to use
  • By submitting coffee bag images, you grant us the right to store and display these images as part of our coffee database
  • You represent that you have the necessary rights to submit these images

Moderation

We reserve the right to moderate, edit, or remove any submissions that don't meet our quality standards or violate these Terms.

7. Intellectual Property

Our IP

The Service and its original content, features, and functionality are and will remain the exclusive property of Beanie Inc. and its licensors. The Service is protected by copyright, trademark, and other applicable laws.

User Content Ownership

You retain ownership of your User Content. However, by posting User Content to the Service, you grant us the license described in Section 5 above, which allows us to use, display, and maintain your content as part of our Service, including after account deletion if anonymized.

Trademarks

Our trademarks and trade dress may not be used without our prior written permission.

Feedback

Any Feedback you provide will be deemed non-confidential and non-proprietary. By providing Feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, copy, modify, create derivative works from, publicly display, distribute, and otherwise exploit such Feedback for any purpose, without acknowledgment or compensation to you. You waive any rights you may have in the Feedback and agree that we are not obligated to use, implement, or respond to any Feedback.

Copyright Infringement

If you believe any content infringes your copyright, please contact us at admin@beanswithbeanie.com with:

  • Description of the copyrighted work
  • Location of the alleged infringement
  • Your contact information
  • A statement of good faith belief

8. Third-Party Services

External Links

The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for such third-party services.

Third-Party APIs

Our Service uses third-party APIs (including OpenAI and Firebase). Your use of features powered by these APIs is subject to their respective terms and policies.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of information as detailed in the Privacy Policy.

10. Disclaimers

Service Availability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE'S OPERATION OR AVAILABILITY.

Coffee Information

While we strive for accuracy, we do not guarantee the completeness or accuracy of coffee information, including but not limited to:

  • Tasting Notes
  • Origin Information
  • Pricing
  • Availability
  • Roaster details

Health Information

The Service is not intended to provide health or dietary advice. Consult appropriate professionals for such guidance.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEANIE INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU (IF ANY) FOR ACCESSING THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless Beanie Inc., its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content
  • Your use of the Service

13. Governing Law and Jurisdiction

For Canadian Users

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions.

For International Users

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Ontario, Canada, except where prohibited by law.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will:

  • Updating the "Last Updated" date
  • Post a notice in the App

Your continued use of the Service after any changes indicates your acceptance of the modified Terms. For material changes that significantly affect your rights, we may provide additional notice through the App or via email.

15. Termination

By You

You may terminate your account at any time through the App settings or by contacting us.

By Us

We may terminate or suspend your account immediately, without prior notice, if:

  • You breach these Terms
  • We are required to do so by law
  • We discontinue the Service

Effects of Termination

Upon termination:

  • Your right to use the Service will cease immediately
  • We may delete your account and associated personal data OR anonymize your contributions
  • Public content (coffee reviews, submissions, public recipes) may be retained in anonymized form
  • Private content (journal entries, private recipes) will be deleted
  • Provisions of these Terms that should survive will remain in effect (including our license to anonymized content)

16. General Provisions

Entire Agreement

These Terms constitute the entire agreement between you and Beanie Inc. regarding the Service.

Severability

If any provision of these Terms is found to be invalid, the remaining provisions will continue in full effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver.

Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

18. Additional Terms for Specific Features

Admin Features

Access to admin features is granted at our sole discretion and may be revoked at any time.

Roaster Features

If you represent a coffee roaster or coffee business:

  • You must have authority to act on behalf of the roaster
  • All information provided must be accurate and current
  • You may not claim ownership of roasters you don't represent
  • Roaster profiles and information are subject to verification
  • We reserve the right to remove or modify inaccurate roaster information
  • You grant us the right to display your roaster's information, logo, and coffee offerings
  • Multiple accounts for the same roaster are prohibited
  • Commercial promotional content must be relevant to coffee and non-spam

Community Features

If you represent a coffee roaster or coffee business:

  • Respect other users and maintain appropriate conduct
  • Not spam or post duplicate content
  • Respect other users' privacy and intellectual property
  • Not impersonate other users or brands
  • Report inappropriate content to admin@beanswithbeanie.com

Commercial Use

Any commercial use of the Service requires our express written permission. This includes but is not limited to using the Service to promote coffee products or services.

Data Export

Upon request, we will provide you with an export of your data in a commonly used format (JSON or CSV).
